On April 13, 2017, the Union filed a grievance on behalf of all affected members against DistinctTech and iVAC Services (collectively, the “Employers”) alleging that the Employers had violated the Utilities Collective Agreement by incorrectly applying the Appendix 1, Article 7 compensation rates for work that should have properly been classified and compensated under the Appendix 1, Article 1 rates (the “Grievance”).
The Grievance covers the period of January 1, 2016 to September 23, 2018 (the “Relevant Period”). The Grievance has been resolved and the Union has $355,505.26 available for distribution to the affected members.
In April 2021, the Union sent all affected members a notice of the settlement. Many, but not all, affected members have come forward. A follow up notice has been sent to the affected members that have yet to respond, based on the mailing address on file with the Union.
